These Terms & Conditions (“Terms”) govern your use of altopeptides.com and every purchase from Alto Peptides (“Alto”, “we”, “us”). By using the website, applying for an account or placing an order, you agree to these Terms, including our Research Use Only policy, Shipping & Returns policy and Privacy Policy, which form part of them.

1. Research use only

All products are sold strictly for in-vitro laboratory research. They are not for human or veterinary use, and they are not drugs, dietary supplements, foods or cosmetics. You agree to use and handle products only as described in our Research Use Only policy. Any other use is a material breach of these Terms.

2. Eligibility and accounts

You must be at least 21 years old and purchasing on behalf of, or in your capacity as, a qualified research organization or professional. Orders are accepted from approved accounts. We may request information to verify your organization and intended use, and may decline or close any account at our discretion. You are responsible for the accuracy of the information you provide and for all activity under your account.

3. Orders, pricing and acceptance

Pricing is provided to approved accounts and may change without notice, but the price confirmed on your order confirmation or invoice applies to that order. An order is accepted only when we confirm it in writing. We may refuse or cancel any order — including for suspected misuse, errors in pricing or product information, or unavailability — and will refund any amount paid for a cancelled order.

4. Payment

Payment is due as stated on your invoice. Unless other terms have been agreed in writing, orders ship after payment is received. You are responsible for any taxes, duties and bank or transaction fees that apply to your order.

5. Shipping, title and risk

Shipping is handled as described in our Shipping & Returns policy. Title and risk of loss pass to you on delivery to the shipping address you provide. Delivery dates are estimates and are not guaranteed.

6. Product specifications and warranty

We warrant that, at the time of shipment, each product conforms to the specifications stated on the certificate of analysis for its lot. If a product does not conform, your remedy is replacement of the product or a refund of its purchase price, at our option, provided you notify us within 7 days of delivery and before further use of the affected lot.

Except for the warranty above, and to the fullest extent permitted by law, products are provided “as is”. We disclaim all other warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We make no representation about the results that may be obtained from using any product in research.

7. Limitation of liability

To the fullest extent permitted by law, Alto will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, lost data or lost research results, arising out of or related to the products, the website or these Terms. Our total liability for any claim relating to an order will not exceed the amount you paid for the products that are the subject of the claim.

8. Indemnification

You agree to indemnify and hold harmless Alto and its owners, employees and suppliers from any claims, losses, liabilities and expenses (including reasonable legal fees) arising from your breach of these Terms, your use, handling, misuse or resale of products, or your violation of any law or third-party right.

9. Resale

If you resell products, you must do so only to buyers who are eligible under these Terms, only for research use, and with the restrictions in our Research Use Only policy passed on in writing. You may not repackage or relabel products in a way that removes or obscures lot numbers or research-use labeling.

10. Website use and intellectual property

Content on this website — including text, graphics, logos and design — belongs to Alto or its licensors and may not be copied or used without our permission. You agree not to misuse the website, including by attempting to disrupt it, gain unauthorized access, or submit false or automated information through its forms.

11. Governing law and disputes

These Terms are governed by the laws of the jurisdiction in which Alto Peptides is organized, without regard to its conflict-of-law rules. Any dispute arising from these Terms or your purchases will be resolved exclusively in the courts of that jurisdiction, unless applicable law requires otherwise.

12. Changes and severability

We may update these Terms from time to time; the version in effect when you place an order applies to that order. If any provision is found unenforceable, the remaining provisions stay in effect.
